01About these terms
These terms and conditions apply to your use of the Bespoke Traffic website and to the services provided by Bespoke Traffic (Company No: 14084744), a company registered in England and Wales whose address is 167-169 Great Portland Street, 5th Floor, London W1W 5PF, United Kingdom ("we", "us" or "our"). By using our website or engaging our services you agree to these terms. If a signed proposal or service agreement conflicts with these terms, the proposal or agreement applies.
02Using our website
The content on our website is general information only and is not tailored advice for your business. We work to keep it accurate and up to date, but we do not guarantee that it is complete, current or error-free. You must not misuse the website, including attempting to interfere with its operation, access it without authorisation or use it for unlawful purposes.
Our website may link to third-party websites. We are not responsible for their content or privacy practices.
03Our services
We provide digital marketing and related services, including SEO, local SEO, AI search optimisation, Google Business Profile management, link building, paid advertising, web design, UI/UX, website maintenance, hosting and domains, content and graphic design. The scope, deliverables, timeframes and fees for each engagement are set out in your proposal or service agreement.
We will provide the services with due care and skill and in line with our proposal. You agree to give us timely access to the information, accounts, approvals and content we reasonably need. Delays in providing these may affect timeframes and results.
04No guaranteed results
Search rankings, AI recommendations, advertising performance and website traffic depend on factors outside our control, including search engine and platform algorithms, competitor activity, market conditions and your own website and business. While we work hard to improve your results, we do not guarantee specific rankings, traffic, leads, sales or return on investment.
05Fees, invoices and payment
Fees are as set out in your proposal and are in Australian dollars and exclude GST unless stated otherwise. Setup and project fees may be invoiced in advance or in stages. Ongoing monthly services are invoiced monthly in advance. Invoices are payable within the time stated on the invoice. We may pause work on overdue accounts.
Advertising spend paid to platforms such as Google, Meta, LinkedIn or TikTok is separate from our management fees and is paid by you directly to the platform unless agreed otherwise.
06Term and cancellation
Unless your proposal says otherwise, ongoing services run month to month after any initial setup period. Either party may end ongoing services by giving 30 days' written notice. Fees for work completed and committed costs up to the end of the notice period remain payable. Fixed-scope projects such as website builds are billed as set out in the proposal, and work completed before cancellation is payable.
07Intellectual property
Once our invoices are paid in full, you own the final deliverables we create specifically for you, such as website content, page copy, designs and ad creative. We keep ownership of our pre-existing materials, tools, templates, processes and know-how, and grant you a licence to use any of these that form part of your deliverables. Third-party items such as stock images, fonts, plugins and themes are licensed under their own terms.
You confirm that any content, logos and materials you give us can be used for the services, and you are responsible for that content.
08Your accounts and access
Marketing, advertising, analytics, hosting and domain accounts should be owned by you wherever possible, with access provided to us. Where we set up an account on your behalf, we will transfer ownership or access to you on request once fees are paid. Domain names registered for you are registered in your name or business details, subject to the registry's eligibility rules.
09Hosting, maintenance and third-party services
Where we provide hosting, maintenance or domain management, we rely on third-party providers. We aim for high availability but cannot guarantee uninterrupted service. You are responsible for renewing services you manage yourself. We are not liable for outages, data loss or changes caused by third-party platforms, although we will take reasonable steps to help restore service.
10Confidentiality
Each party will keep the other's confidential information private and use it only for the purposes of the engagement, unless disclosure is required by law. We may mention you as a client and show work we have produced for you in our portfolio, unless you ask us not to.
11Liability
Nothing in these terms excludes rights you may have under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, our total liability arising from the services is limited to the fees you paid us for the relevant service in the three months before the claim arose, and we are not liable for indirect or consequential loss, including lost profits, revenue or data.
12Governing law
These terms are governed by the laws of New South Wales, Australia, and each party submits to the courts of that state. We may update these terms from time to time, and the latest version will always be on this page.
